COLE NISSAN ONE TO ONE REWARDS PROGRAM TERMS AND CONDITIONS

The following document details the terms and conditions of Cole Nissan One to One Rewards Program.

Upon receipt of the membership key tags the member agrees to be bound by the program rules, terms and conditions.  Cole Nissan One to One Rewards program members will receive incentive points for every dollar spent on parts and services up to $250 on a vehicle purchase.  These points are only redeemable at Cole Nissan.  This program is at no cost to you.  Simply swipe your card with our cashier when you pick up your vehicle and we will take care of the rest.  With every dollar of customer pay service and or parts we will apply 3% of your total bill (excluding taxes) to your preferred card in the form of award dollars.  We are a full-service maintenance and repair center.  As an authorized Nissan Dealer, our customers are assured of the availability of Genuine Nissan Parts for all vehicle maintenance and repair needs.

OVERVIEW OF COLE NISSAN ONE TO ONE REWARDS PROGRAM

The Cole Nissan One to One Rewards Program is a loyalty program sponsored by Cole Nissan that allows owners to earn incentive points towards future service, retail parts and accessories from Cole Nissan up to a maximum of $250 in any one transaction.  All earned award points can be used for retail purchases at Cole Nissan ONLY.

PROGRAM RULES

1.       Program dollars have no cash value and cannot be redeemed for cash.

2.      Any items purchased through the Cole Nissan One to One Rewards Program cannot be returned for cash.  The value of any returned items will be applied to the Nissan One to One Rewards card.

3.      Award points will expire within 24 months of inactivity.

4.      Reward points redemption is not combinable with any other discount offers.  Cole Nissan reserves the right to determine redemption eligibility.

5.      Your One to One Rewards Card can be used for any vehicle in your household.

6.      Award points can only be earned on cash purchases.  Qualified purchases include retail parts, detail services, maintenance, repairs and accessories.  Each of the points earned is equal to one dollar in awards discounts.  You cannot accrue points on new or used vehicle purchases, warranty, insurance or extended service contract purchases.

7.      Members must present valid membership card at time of purchase in order to redeem points.

8.      Reward Points may not be transferred from account to account or from one member to another.  Membership and points cannot be sold, bartered, brokered or transferred for any reason including death and domestic matters.  Membership and points have no cash value.

9.      PROGRAM POINTS CANNOT BE COMBINED WITH A VPP PURCHASE.

EARNING PROGRAM DOLLARS

When first enrolled in the Program, the new Member will receive a Cole Nissan One to One Rewards Card.  The card is to be used for each eligible future transaction.  Incentive points can be earned in the follow manners:

1.      A new vehicle purchase may earn up to $250 towards a future vehicle purchase.

2.      Each retail cash transaction in parts or service will earn 3% of total dollars spent (less tax) towards a future service, parts or accessory sale.

3.      Shop through this portal:  www.nissanonetoonerewards.com and earn additional rewards.  Sign into www.nissanonetoonerewards.com and click on the "Shop" icon.  Over 300 retail outlets will credit your Nissan One to One Rewards card with additional points that can be used at Cole Nissan for future retail service, maintenance, parts and accessory purchases. You may also receive exclusive discounts at participating retailers. 

4.      Member reward points can be checked at Cole Nissan or online at www.nissanonetoonerewards.com or follow the link at www.cole-nissan.com.

Participation in the Program

The program is available to all Cole Nissan customers who are over the age of 18.  Cole Nissan employees are not eligible to participate in the Program.  Fleet or wholesale customers are not eligible to participate in the program.

Participation in the program constitutes that each Cole Nissan One to One Rewards member has fully and unconditionally agreed to these Terms and Conditions.

The personal information that is collected from each customer in connection with the Program will be used in accordance with the Cole Nissan Privacy Policy.

General Terms and Conditions

Cole Nissan may modify any of the terms and conditions governing the program including, but not limited to, the methods through which incentive points can be earned, how the Program can be used, the value of the earned points at any time and without notice.

The Program has no pre-determined termination date and may continue until such time that Cole Nissan may terminate the program with no notice given.  Accrued Cole Nissan One to One Rewards Points is not the property of the Reward program member and has no value outside of this program.  Program Owner dollars are credits that Cole Nissan may revoke at any time.  Reward Points may not be exchanged for cash, assigned, bartered or transferred.  Each Program Member is responsible for ensuring that the information in his/her account is accurate and kept current.

Abuse of the Cole Nissan One to One Program, (including failure to follow program policies and procedures, the sale or barter of rewards and any misrepresentation of facts relating thereto or other improper conduct, as determined by the Dealer) may result in cancellation of the member's account and future disqualification from program participation and forfeiture of all points accrued.  Dealer reserves the right to take appropriate legal action, as it deems necessary, and to recover damages, attorney's fees and other court costs.

Limitation of Liability governs that each Program member accepts all responsibility for and hereby indemnifies and holds harmless Cole Nissan and each of their related companies (Nissan) and respective officers, directors, employees, shareholders, agents and successors and assigns the Released Parties from and against any claims that may arise from actions taken by such Member or for any unauthorized access to Cole Nissan One to One Rewards account by a third party.  Under no circumstances, including but not limited to negligence, shall the Parties be liable for any direct, indirect, incidental, special or consequential damages arising out of the program.  By participating in the Program, a Rewards Member waives and all rights to bring any claim or action related to such matters in any form.
